Terms of Service

1. Acceptance of Terms

CameraSim Classroom (the “Service”) is operated by Tuitive LLC (“Tuitive,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

CameraSim Classroom helps photography teachers give their students access to interactive exposure courses and camera simulators, including the Clicked! course, Field Trip, and CameraSim’s classic simulators. Teachers create classes and share access links with their students. We may add, change, or remove features at any time.

3. Accounts and Eligibility

The Service is intended for teachers and educators. You must provide accurate account information and are responsible for activity under your account. You are responsible for the students you enroll, including obtaining any parental or school consent required by applicable law before adding students to a class. You agree not to share your account credentials.

4. Subscriptions, Billing, and Payments

• Paid plans are billed on a subscription basis. Pricing and seat limits are shown at the time of purchase (for example, an annual plan covering up to 50 students).
• Payments are processed securely by Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method for the applicable fees.
• Subscriptions renew automatically at the end of each billing period unless you cancel beforehand. You can manage or cancel your subscription through the customer billing portal.
• Fees are stated exclusive of taxes, which may be added where applicable.

5. Refunds

We offer a 60-day refund guarantee: if the Service does not work for your class, contact us within 60 days of your purchase at support@camerasim.com for a full refund. Except as required by law or as described here, fees are otherwise non-refundable.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful or harmful purpose.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Copy, resell, or redistribute the Service or its content except as expressly permitted.
• Upload content that infringes others’ rights or violates applicable law.

7. Intellectual Property

The Service, including its courses, simulators, software, text, graphics, and logos, is owned by Tuitive LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for educational purposes during your subscription. All rights not expressly granted are reserved.

8. Student Data

You are responsible for the student information you enter into the Service. We collect only the minimal student information described in our Privacy Policy and delete student data when you delete the associated class. You represent that you have the authority and any necessary consents to provide student information to the Service.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Tuitive LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

11. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, and we may delete your data as described in our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the State of [State] and the United States, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in [State].

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
